$1.1 Million Settlement won by Maxted Law LLC for Jail Wrongful Death

In the case of Estate of Kyle Yoemans v. Adams County, civil rights attorney David Maxted of law firm Maxted Law LLC secured a $1.1 million settlement against the County after leading the case through discovery and defeating the defense motion for summary judgment. With the case set to proceed to trial, the County and other defendants agreed to this substantial settlement for the plaintiff. The case involved claims of deliberate indifference and failure to protect under 42 U.S.C. 1983 and the Eighth and Fourteenth Amendments. Kyle Yoemans was housed in a cell with a violent, dangerous individual who killed him overnight. The Sheriff, Adams County, and other individuals were sued for endangering Yoemans and failing to house him safely. This $1.1 million settlement follows a confidential settlement reached against a private medical contractor who was also named in the lawsuit.
