Put simply, it isn’t enough to obtain financial settlements. Real change requires taking unjust policies and systems head on, through systemic litigation, community advocacy, and legislative and policy change.

Examples of our successful systemic litigation include:

  • Rustgi v. Reams: obtaining a settlement with Weld County jail requiring substantial policy change to end policies and use of a contractor relating to excessive force in the jail. 

  • Carranza v. Reams: winning a class action preliminary injunction against Weld County jail due to failure to protect people from COVID-19 at the beginning of the pandemic.

  • Weikert v. Elder: winning a class action preliminary injunction against El Paso County jail in Colorado Springs due to failure to protect from COVID-19, including failure to provide masks to detained individuals.

  • Winston v. Polis: securing a consent decree with CDOC to protect individuals from COVID-19. Dave Maxted also led the team succeeding on appeal to win a Court of Appeals ruling that the Governor may be sued for prison civil rights violations. 

  • Lilgerose v. Polis: Dave Maxted filed a landmark class action lawsuit to end involuntary servitude in Colorado prisons, along with labor non-profit Towards Justice. A motion to dismiss filed by the Governor and CDOC was partially denied. The case remains pending.
